While originally touted as a means to preserve home values, homeowner associations have become the norm instead of the exception.

The existence of an HOA whether silent or active is one of several disclosures a Seller is required to submit to a buyer for their approval during the escrow process.  Although a specific timeline applies for such disclosure, a buyer has 5 days from receipt to either approve or disapprove the information provided. These items include: all fees due and payable, the interval of payments and items for which payments apply,  the CC&R's (Codes, Covenants, and Restrictions) which are the rules every homeowner must agree to abide, and the "Financials" depicting solvency along with the current year's budget, naming a few.

Moving past dues, what gives most buyers pause are the community rules which may dictate anything from parking to pets, and in some communities, the number of guests a resident may have and the length of their visit.
